Agreement to Our Legal Terms
We are Plotwise Limited ("Company," "we," "us," "our"), a company registered in Kenya at ABC Place, 10th Floor, Waiyaki Way, Nairobi, Nairobi. We operate https://plotwise.co and related services that link to these legal terms (the "Services"). Contact us at hello@plotwise.co.
These Legal Terms are a binding agreement between you (personally or on behalf of an entity) and Plotwise Limited about your access to and use of the Services. By using the Services, you agree to these Legal Terms. If you do not agree, do not use the Services.
We may update these Legal Terms from time to time and will update the "Last updated" date when we do. Your continued use of the Services after changes are posted means you accept the revised terms.
The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.
1. Our Services
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
2. Intellectual Property Rights
We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks"). Our Content and Marks are protected by copyright and trademark laws and treaties around the world.
The Content and Marks are provided in or through the Services "AS IS" for your personal, non-commercial use or internal business purpose only.
Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use or internal business purpose.
Any breach of these Intellectual Property Rights will constitute a material breach of these Legal Terms and result in immediate termination of your right to use our Services.
3. User Representations
By using the Services or accessing this website, you confirm that you have read, understood, and agreed to be bound by these Legal Terms. You further represent and warrant that:
- You have the legal capacity and agree to comply with these Legal Terms;
- You are not a minor in the jurisdiction in which you reside;
- You will not access the Services through automated or non-human means;
- You will not use the Services for any illegal or unauthorized purpose; and
- Your use of the Services will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we reserve the right to suspend or terminate your account and refuse any current or future use of the Services.
4. Purchases and Payment
Payments for paid plans are processed by Paystack using the payment methods it makes available at checkout (for example, cards and other local methods).
You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services and to keep it updated so we can complete transactions and contact you as needed. All payments shall be in Kenyan Shillings (KES) unless otherwise stated at checkout.
You authorize us to charge your chosen payment provider for the applicable amounts upon placing your order. We reserve the right to correct any pricing errors, even if payment has already been received.
Paid plans are offered as fixed subscription terms (for example, 1, 3, 6, or 12 months). Subscriptions are non-recurring and do not auto-renew. You keep access to paid features until the end of your purchased subscription term, and you can buy a new term when your current term ends.
We may offer a short preview period that provides access to paid features without immediate payment. Preview access ends automatically at the end of the preview period unless you purchase a paid subscription term.
We may introduce fees for parts of the Services that were previously free, or change pricing and plan tiers at any time. We will notify you of material pricing changes before they take effect, and your continued use of the Services after the effective date constitutes acceptance of the new pricing.
Certain features may be released as beta, limited, or trial experiences and may be modified, suspended, or discontinued at any time without liability to you.
All sales are final and no refund will be issued unless required by law. This does not limit any statutory consumer rights.
5. Prohibited Activities
You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those specifically endorsed or approved by us.
As a user of the Services, you agree not to:
- Systematically retrieve data or other content from the Services to create or compile a database without our written permission.
- Trick, defraud, or mislead us or other users, particularly in attempts to gain sensitive account information.
- Circumvent or interfere with security-related features of the Services.
- Disparage, harm, or otherwise damage the reputation of the Services.
- Use any information obtained from the Services to harass, abuse, or harm another person.
- Engage in unauthorized framing, data mining, or use of automated systems.
- Remove or alter copyright or proprietary notices.
- Impersonate another user.
- Upload or transmit viruses, Trojan horses, or other harmful materials.
6. User Generated Contributions
The Services may invite you to submit content, such as comments, images, or listing information (collectively, "Contributions"). Some Contributions may be displayed publicly where the relevant feature indicates this at the time of submission. We process Contributions to provide and operate the Services.
You are solely responsible for your Contributions and must ensure they do not violate these Legal Terms.
7. Contribution Warranties
By submitting Contributions, you represent and warrant that: (a) you have the rights and permissions to provide them; (b) they do not violate any laws, privacy rights, intellectual property rights, or third-party agreements; (c) any submitted files are free of malicious code; and (d) you will not include prohibited sensitive data unless we expressly allow it.
8. Third-Party Websites and Content
The Services may contain links to third-party websites or display third-party content. We do not guarantee the accuracy or privacy practices of these third parties and are not responsible for any harm arising from your use of them.
If you leave the Services to access third-party content, you do so at your own risk.
9. Services Management
We reserve the right to monitor the Services for violations of these Legal Terms and to take appropriate legal action if necessary. We may restrict, disable, or remove any user Contributions at our discretion.
This includes managing the Services in a manner designed to protect our rights and property.
10. Privacy Policy

11. Term and Termination
These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right, in our sole discretion and without notice, to deny access to the Services or terminate your account if you breach these Legal Terms.
If your account is terminated, you are prohibited from creating a new account.
12. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Services at any time without notice. We are under no obligation to update any information on the Services.
We make reasonable efforts to keep the Services available, but we do not guarantee uninterrupted or error-free operation. The Services may be unavailable for maintenance, upgrades, or circumstances beyond our reasonable control, including third-party failures.
We do not guarantee continuous availability of the Services and are not liable for any interruptions or errors.
We reserve the right to correct any typographical errors, inaccuracies, or omissions in the information provided on the Services at any time without prior notice.
13. Governing Law
These Legal Terms shall be governed by the laws of Kenya.
14. Dispute Resolution
Any dispute arising out of or in connection with these Legal Terms shall be resolved exclusively by binding arbitration under the rules of the Nairobi Centre for International Arbitration. The arbitration will be conducted in Nairobi, Kenya, in English.
Certain disputes, such as those involving intellectual property rights or claims for injunctive relief, are excluded from arbitration.
15. Disclaimer
The Services are provided on an "as is" and "as available" basis. Your use of the Services is at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant the accuracy or completeness of the Services' content and will not be liable for any damages arising from your use of the Services.
The information provided on this platform—including data supplied by Plotwise Limited and contributions from other users—is offered for general informational purposes only. The accuracy, completeness, or timeliness of the information on Plotwise is not guaranteed. For verified or legally reliable data, users are strongly advised to consult professional experts or official government sources such as Ardhisasa or the Survey of Kenya. Plotwise Limited is not liable for any errors or omissions and shall not be responsible for any decisions made based on this information.
16. Limitations of Liability
In no event will we or our directors, employees, or agents be liable for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Services, even if advised of the possibility of such damages. Our liability shall be limited to the amount paid by you to us during the six (6) month period prior to any cause of action.
17. Indemnification
You agree to defend, indemnify, and hold harmless Plotwise Limited, including its subsidiaries, affiliates, officers, agents, partners, and employees, from any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, arising out of your use of the Services or your breach of these Legal Terms.
18. User Data
We will maintain data that you transmit through the Services for performance management and usage tracking. Although we perform regular backups, you are solely responsible for any data loss or corruption.
19. Electronic Communications, Transactions, and Signatures
Your interactions with the Services, including emails and online forms, constitute electronic communications. By using the Services, you consent to receive electronic communications and agree that these communications satisfy any legal requirements to be in writing.
20. Miscellaneous
These Legal Terms, along with any policies or operating rules posted by us on the Services, constitute the entire agreement between you and Plotwise Limited regarding your use of the Services. Our failure to enforce any right or provision of these Legal Terms will not operate as a waiver. If any part of these Legal Terms is found to be unenforceable, it will be severed from the remainder, which will continue in full force and effect.
Nothing in these Legal Terms shall create a joint venture, partnership, employment, or agency relationship between you and us.
